On 08.06.24, the NYPD issued an emergency rule in regards to how they concealed carry permits, which has made several updates to the way the NYPD Licensing Division operates and issues these permits.
The key takeaways are as follows:
Non-Residents of NY may apply to the NYPD even if they have no ties to the city such as employment for a concealed carry permit.
If the permit is issued, the licensee will abide by the rules and laws within the City of New York with respect to carrying a concealed handgun.
You may not have been convicted of Assault in the third degree, Menacing or misdemeanor DWI within 5 years of the date of application.
Non-Residents must complete the 18 hours of training to be issued the permit. You can book our 18-Hour training class here!
We believe this case was an attempt to moot Higbie et al v. James et al lawsuit that was filed with the help of GOA, which was filed in the northern district court. We have come to this conclusion, as non-NY residents can not apply for a permit in any other county, but only in New York City–which has the most drawn out application process and is the most expensive licensing fees in New York state and additional fees for fingerprinting.
We don’t think the aforementioned was a coincidence.
We are fighting the high cost of licensing fees in our lawsuit. In an attempt to moot our lawsuit, as well as several other lawsuits, they have also adjusted the number of handguns one may own on specific licenses.
For premise residence permits, you may have more than one handgun if you have evidence of appropriate safeguarding and you comply with the mandatory waiting periods (90 days).
For Carry licenses, you may have two handguns and may have more than two if you comply with the above premise residence requirements for safeguarding your firearms.
Special carry licenses will require you to submit your county carry license, purchase authorization form and copy of a bill of sale.
We believe the NYPD’s adjustments still infringes upon our rights, and that we should not be required to request permission to obtain new firearms. Even less so, beg them to allow us to add them to our permits, which is essentially a permission slip for a permission slip.
This changes nothing in regards to our lawsuit and we will still seek a judicial declaration that their actions are unconstitutional.
