The Foundation for a Safer New York is committed to challenging legal barriers that infringe upon the rights of New Yorkers. One of our primary legal actions, Mills v. The City of New York, addresses several concerns:
Excessive Permitting Fees: We contend that the substantial fees required to obtain firearm permits in New York City are prohibitive and infringe upon constitutional rights.
Restrictive Regulations: Our lawsuit challenges specific provisions, such as 38 RCNY 5-22(a)(7)-(10) and 38 RCNY 5-25, which impose stringent conditions on firearm licensees, including limitations on the number of handguns one can carry and the requirement for written permission for purchases or replacements.
Acquisition Limitations: We are contesting NYC Administrative Code 10-302.1(a)-(e), which restricts individuals from acquiring more than one firearm, rifle, or shotgun within a 90-day period.
Our objective is to obtain judicial declarations that these regulations violate the Second and Fourteenth Amendments, seeking their permanent injunction to uphold the constitutional rights of New Yorkers.
Following the dismissal of our lawsuit by Judge John G. Koeltl on September 25, 2024, we promptly filed an appeal on December 20, 2024, to challenge this decision and continue our fight for the constitutional rights of New Yorkers.
