On 09/25/2024 Judge John G. Koeltl wrongfully dismissed our lawsuit against New York City with the following docket text and no ruling:
ORDER granting [13] Motion to Dismiss. Before the Court is the opposed motion of defendant New York City to dismiss the complaint in the above-captioned case (ECF No. 13). The Court invited the parties to provide supplemental briefing in light of the Supreme Court's intervening decision in United States v. Rahimi, 144 S. Ct. 1889 (2024), and they did so (ECF Nos. 24, 25). After careful consideration, the Court grants defendant's motion to dismiss in full. A memorandum explaining the reasons for this ruling will issue in due course, at which time final judgment will be entered. SO ORDERED.. (Signed by Judge John G. Koeltl on 9/25/2024) (ks)
Why Judge Koeltl decided to release this without a full ruling makes no sense to us, but it is where we currently are.
What does this mean for us?
This means the lawsuit will not currently continue until Judge Koeltl issues his ruling. We will then read and appeal the decision to the Second Circuit Court of Appeals. We will continue to press this issue until we get a positive ruling in our favor as this is an incredibly important issue for us to win.
Ultimately, we knew something like this was going to happen, as New York State and the judges here understand that the game is over for them with the Second Amendment.
As we’re going through the appeal process, we’ll be incurring fees and your support is more important than ever, feel free to take a look at the original funding pages below!
